Neil Nazareth and Jeremy Landry represent the condominium association for the Jax Brewery building in a lawsuit brought for property damages sustained as a result of Hurricane Ida. Jax Brewery is a commercial and residential building that includes retail stores, restaurants and residential condominiums. The lawsuit alleges substantial damages to the historic building, including roof, stucco and window damage and water penetration damage caused by the hurricane winds. The claims against the insurers are for breach of contract and bad faith for the insurers’ alleged failure to fully and timely pay the losses covered under the policy and as required by Louisiana law. The Plaintiff is seeking full coverage for losses sustained under the 18 million dollar policy plus statutory damages, attorney’s fees, and costs for the insurers’ alleged breach of contract and bad faith claims handling practices. The lawsuit is pending in New Orleans before the United States District Court for the Eastern District of Louisiana.
