Neil Nazareth and Jason Landry of Martzell, Bickford & Centola have resolved a product liability case for a man burned while using a consumer product. The case involved claims under the Louisiana Products Liability Act (LPLA) against the manufacturers of the product and its component parts, in particular claims for failure to warn of the dangers associated with the product. Expert engineers were retained to show that the harm inflicted upon the client could be caused by the ordinary use of the product and that alternative designs of a substantially similar product were available that would have decreased or eliminated the product’s propensity for causing harm. Within 2 years, we were able to resolve the case for a 7-figure sum for the plaintiff and his family.
